TERM & CONDITIONS AND OUR POLICIES

1. Information About GK

We are GK Tuition Limited, a company registered in England and Wales. Our company registration number is 09316285 and our trading address is Aurora House, 22 Kennington Park Gardens, London, SE11 4AX. 2. Our Services

The services are as described in the application form and in these terms and conditions.
Any variation to the services must be agreed by GK.
The services shall start on the date set out in the application form and shall continue until the services are complete or you end the contract as described or we end the contract by written notice to you.
The services shall be carried out at the location described on the application form or other location as agreed by you and GK. We shall refer to this as the tutoring venue.
We shall discuss and agree dates for the delivery of services with you. If our supply of the services is delayed by an event outside our control, then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any services you have paid for but not received.
We may need certain information from you so that we can supply the services to you, for example, details of your child’s exam syllabus and educational requirements. We will provide a diagnostic form to you so that you can provide this information to us. If you do not give us this information within a reasonable time of asking for it, or if you give us incomplete or incorrect information, we may either end the contract or make an additional charge of a reasonable sum to compensate us for any extra work that is required as a result. We will not be responsible for supplying the services late or not supplying any part of them if this is caused by you not giving us the information, we need within a reasonable time of asking for it.

3. Failure to Give Notice

Unless terminated under Condition 3 above, this agreement shall continue unless the client or tutor has served notice to terminate this Agreement in accordance with Condition 3(b) above or the signatories have agreed to terminate the Agreement in accordance with Condition 3 (a) above. Where clients fail to give notice of termination, one month’s lesson fees will be payable in lieu of notice.

4. Lesson Cancellation

To cancel a scheduled lesson, please give notice at least 24 hours in advance. Failure to provide at least 24 hours’ notice will result in the time being invoiced apart from where there has been a death in the family. If a cancellation is made with more than 24 hours’ notice, an alternative tuition time will be offered, though the client must accept that it may not always be possible to accommodate rescheduling of lessons, in which case the lesson will be missed, and no invoice will be given in respect to the session. Cancellation with less than 24 hours’ notice due to student illness will be invoiced. Cancellation with less than 24 hours’ notice due to tutor illness will not be invoiced, but the opportunity for a session at a mutually convenient alternative time will be arranged as soon as possible. Cancellation with more than 24 hours’ notice on either side will not be invoiced.

5. Make-up Lessons

If the tutor is unable to give a scheduled lesson, an alternative time will be offered where possible. If the student is unable to attend a scheduled lesson, every effort will be made to provide a make-up lesson if proper notice is given.

6. Lateness

Lessons will start at their scheduled time. If a student is late, the time will not be made up. Where tutors are travelling to students, students should be ready to start their lesson at the allocated time. However, it should be appreciated that where tutors are travelling to students there may, on occasion be unavoidable delays due to traffic, extended communication with parents etc. Where lessons start after their scheduled time due to tutor lateness, the time will be made up. Student lateness in excess of 15 minutes will result in a cancelled lesson. The lesson fees and travel charges (if applicable) will not be refunded, and there will be no make-up lesson scheduled. Tutor lateness in excess of 15 minutes will be communicated by text message as soon as is reasonably practicable.

7. Lesson Requirements

Students should bring the following items to every lesson: books they are currently working out of, notebooks/paper, calculator, and appropriate stationary. Students should come to each lesson with any homework set by the tutor, completed and be ready to discuss what they are working on.

8. Code of Conduct

When tuition takes place in the client’s home, students, parents, and other residents are requested to refrain from smoking inside the house for the duration of the lesson. Where students are under 18, tuition will only take place where a responsible adult is always in the house. If a responsible adult is not home for the full duration of the lesson, the lesson will be terminated or will not start, but the full lesson fee will be payable. Where tutors are travelling to students, students and adult members of the household should be fully dressed in daytime clothes on arrival (not pyjamas). It is appreciated that this may not be appropriate or feasible for younger members of the household, where sessions are held after 8pm. Where tuition will take place at the clients’ home, space should be provided for tuition where the responsible adult can be always accessible. Under no circumstances will tuition take place in a bedroom. Students and their parents are to refrain from using inappropriate, disrespectful, or aggressive language and/or behaviour during, before or after lessons. Aggressive or threatening behaviour will result in immediate termination of the tuition agreement. Any fees paid for future lessons will be forfeited. The first offense will result in a verbal warning. The second offense will result in a written warning. The third offense will result in automatic withdrawal from lessons with the tutor. In this case, the payment schedule will revert for the case of termination without notice.

9. Trial Period

The first _2_ week(s) of care shall be a trial period. During this trial period, either party may discontinue care with written notice. Termination of childcare during this period will terminate this agreement. Parent(s) shall pay for days that care was provided.

10. Arrival and Collection

It is the responsibility of the parent/guardian to bring their child into to the venue before their session and to collect them at the end of the session. Children will not be permitted to leave the premises under any circumstances unless accompanied by named parent/guardian. Children will only be released to named adults unless prior notification has been given in writing.

11. Rates for Holidays, Absences, Vacations, Overtime

Care will be provided, and payment is due, on the following holidays/breaks when they occur on a day the child(ren) is/are regularly scheduled for care:
October Half Term, Easter Holidays, Christmas Holidays, May Half Term, February Half Term and Summer Holidays.

12. Policy for Payment of Absences is:

Full payment to be paid for any informed or uninformed absence. Compensation will be arranged/offered by mutual agreement of the parent and the provider within following 4 weeks’ time. If a child/parent is unable to make time for any missed session due to any reason during this period, unfortunately the session cannot be repeated due to lack of time.

13. Fees and policies for parent/guardian's vacation

Full payment to be paid for any informed or uninformed absence. Compensation will be arranged/offered by mutual agreement of the parent and the provider within following 4 weeks’ time. If a child/parent is unable to make time for any missed session due to any reason during this period, unfortunately the session cannot be repeated due to lack of time.

14. Valuables

a) Please note that, in the interests of safety, GK does not allow mobile phones to be switched on during the entire sessions. We strongly advise that no other gadgets of any kind are carried by children to the premises. We do not take any liability for any damage or loss to such property while the child is on the premises.
b) GK is not responsible for any items left by you at the Centre, including without limitation, study books, stationary, push chairs, prams, car seats and clothing.

15. Damages

a) Please note that, in the interests of safety, GK does not allow mobile phones to be switched on during the entire sessions. We strongly advise that no other gadgets of any kind are carried by children to the premises. We do not take any liability for any damage or loss to such property while the child is on the premises.
b) GK is not responsible for any items left by you at the Centre, including without limitation, study books, stationary, push chairs, prams, car seats and clothing.

16. Removal

All damage must be paid for regardless of whether it was accidental or deliberate; The provider will charge parents/guardian for all damage at an appropriate cost (including materials, labour and admin) which will be determined by the business manager.
(This does not apply to normal wear and tear on equipment/furniture, only to damage.)

17. Termination Procedure

a) This contract begins on the following Date: and may be terminated by either parent/guardian or provider by giving minimum one calendar month’s written notice. After the trial period, both parties must give at least one calendar months’ notice in writing before termination of care. Childcare fees must be paid for the one calendar months’ notice period whether or not the child is in care.
b) The parent(s) and provider will make every effort to make the program work for each child, and to communicate and work together if there are concerns. Reasons for termination of care include, but are not limited to:
• Availability of resources to meet the child’s needs and the parent’s willingness to access them.
• Ability of provider/program to meet the child’s needs.
• The impact of the child’s needs/behaviour on the program.
• Willingness of the parent(s) to work with the provider.
• Failure of parent(s) to fulfil their contractual agreement.
• Failure of parent(s) to fulfil their contractual agreement.
• Repetitive late pick-up.

18. Arrears

a) We require payment to terms. Payment must be made on time, in full, and without any deduction, off set or counterclaim. In the event that an account is outstanding, we will refer the matter to our debt collection agents, Daniels Silverman Limited, which will incur additional costs. The additional costs incurred to collect the debt will be added to the debt, plus VAT at the prevailing rate. You agree that you will be legally liable to pay the outstanding account plus additional costs, and that payment of the same can be enforced against you in court. If applicable, you also agree to pay compensation and interest at the relevant reference rate, as provided for under the Late Payment of Commercial Debts (Interest) Act 1998.”
b) We are not liable for collections from third parties, e.g., colleges/universities, grant funding, voucher provider and the parent remains responsible for all outstanding fees. If you leave the care with outstanding fees, details of your name, address and payment record will be given to our debt collection agents, Daniels Silverman Limited, and debt recovery charges and legal costs will be added to your account.

19. Complaints

It is important that all clients are happy with the service that they receive, and tutors employed by GK will be closely monitored. After the first session, we will contact you to ensure that you were satisfied with the service provided, and to ask for any feedback. In the unlikely event that you are unhappy with the tuition service provided at any point, please contact us as soon as any issue arises, and I will attempt to resolve any issues. In the case of an irrevocable break-down in the relationship between the Client and their Tutor, the assigned Tutor may be replaced, if another suitably qualified Tutor is available and if the replacement tutor is acceptable to the client.

20. Our Responsibility for Loss or Damage Suffered by You

a) Nothing in these terms and conditions shall exclude or limit our liability for death or personal injury, caused by our negligence or the negligence of our employees, agents, or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the services, including the right to receive the services as described, of satisfactory quality; and supplied with reasonable skill and care under the Consumer Protection Act 1987.
b) If we are providing services in your property, we will make good any damage to your property caused by us as a direct consequence of our actions.
c) We are unable to guarantee the success of any pupil in sitting any exams, courses, interviews or submitting any CV or job applications based on the services we provide,and we cannot accept any liability for any failure of the pupil in connection with the services we provide.

21. General Conditions

a) The Supervisor must be notified in writing immediately of any changes in contact details or family situations, Court Orders, or situations of risk in relation to the child for which any special precautions may be needed.
b) GK welcomes staff and children from many different ethnic groups, backgrounds, and creeds. Similarities and differences are valued and respected and all children are treated equally. GK will comply with the Special Educational Needs and Disability Act 2001 and will do all that is reasonable to accommodate the needs of children with disabilities.
c) The parents/Carers hereby confirm that they accept the authority of the Supervisor and staff to take all reasonable disciplinary or preventative action necessary to safeguard and promote the welfare of each child and the GK staff and community.
